1. INTELLECTUAL PROPERTY NOTICE

NOVA Mail respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the following policy regarding copyright infringement.

2. NOTICE OF INFRINGEMENT

If you believe that any material available on or through the Service infringes your copyright, you may submit a written notification ("DMCA Notice") to our Designated Copyright Agent containing the following information:

Required Information:

  1. Your physical or electronic signature (of the copyright owner or a person authorized to act on their behalf);
  1. Identification of the copyrighted work claimed to have been infringed, or if multiple works, a representative list;
  1. Identification of the infringing material and information reasonably sufficient to permit us to locate the material (e.g., the full email headers, sender address, timestamp, and subject line);
  1. Your contact information, including your name, address, telephone number, and email address;
  1. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  1. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. COUNTER-NOTIFICATION

If you believe that material you submitted was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification containing:

  1. Your physical or electronic signature;
  2. Identification of the material removed and its location before removal;
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, telephone number, and email address;
  5. A statement consenting to the jurisdiction of the federal district court for your judicial district (or the district where NOVA Mail is located), and that you will accept service of process from the person who provided the original DMCA notice.

4. REPEAT INFRINGERS

NOVA Mail reserves the right, in its sole discretion, to terminate the accounts of users who are repeat infringers of intellectual property rights. A "repeat infringer" is any user who has been the subject of more than two valid DMCA notices.

5. ACCOUNT TERMINATION

Without limiting the foregoing, NOVA Mail reserves the right to immediately terminate the account of any user who:

a) Is determined to be a repeat infringer; b) Knowingly submits false or misleading DMCA notices or counter-notifications; c) Uses the Service primarily for the distribution of infringing content.

6. MODIFICATIONS

NOVA Mail reserves the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting to the Service.
